Code of Conduct

Khan’s Tutorial (KT) is committed to the highest standards of social responsibility and ethical conduct while providing a safe environment for our students and staff. All KT participants are expected to act lawfully, honestly, ethically, and in the best interests of our students and our staff. KT requires its participants to function in accordance with the principles outlined here and in full compliance with all applicable laws and regulations. This Code goes beyond mere compliance with the law by drawing upon internationally recognized standards to advance social responsibility and to ensure that all KT Staff & participants are to be treated with dignity and respect and act fairly and justly. KT reserves the right to remove participants from the program who violate this code at any time for any reason. This code is subject to change and may be amended, supplemented or superseded by one or more separate policies.

Integrity & Honesty

Our reputation as a company that families can trust is our most valuable asset, and we ask that all KT participants in our programs maintain the highest standard of trust. At no time should a KT participant be dishonest with our staff.

Positive Environment

KT prohibits harassment in any and all forms – verbal, physical, sexual, or visual. Offensive conduct may include, but is not limited to, bullying, offensive jokes, slurs, epithets or name calling, physical assaults or threats, intimidation, ridicule or mockery, insults or put-downs, offensive objects or pictures, and interference with work performance. Harassment can occur in a variety of circumstances and KT will not tolerate any form of harassment from KT participants.

Refund Policy

KT is committed to providing participants with the highest quality tutoring services possible. However, please note that our program operates under a strict no-refund policy. This means that once you have enrolled in our tutoring program, we will not provide any refunds for any reason whatsoever.

KT believes that our program offers exceptional value and we are confident that you will benefit greatly from the tutoring services we provide. However, we cannot guarantee specific results, outcomes, or actual exam dates. We cannot be held responsible for any factors that may impact your ability to fully participate in the program.

We recommend that you carefully consider your decision to enroll in our tutoring program before making a payment. By enrolling in our tutoring program, you agree to abide by this no-refund policy.

As part of KT’s Terms of Service, participants have agreed they will not disparage, defame or make any negative comments or statements about KT, our performance, our principals, tutors or methodology, whether verbal or in writing, or otherwise post, publicize or take any action which could reasonably be expected to adversely affect KT’s personal or professional reputation on any Social Media Website, Web Portal or Platform.

Participants are prohibited contractually from going on the internet, social media, printed media or in any forum to make (i) make any negative statements, whether truthful or not, or take any other actions whatsoever, to disparage, defame, sully or compromise the goodwill, name, brand or reputation of KT or any of its affiliates or (ii) commit any other action that could likely injure, hinder or interfere with the business, business relationships or company goodwill of the company or its affiliates.

Participants in our program and their parents/guardians represent and warrant that they will at no time commit any of the preceding actions described in this Section. This section is material consideration for the parties entering into said terms of service and shall survive for 10 years after beginning services with KT.

No Soliciting Tutors for Private Hire Allowed

Participants shall not hire, employ, contract, or retain KT tutors for private instruction of any kind. Participants cannot text, call, or email tutors outside of the period of the program enrolled for. Tutors are contractual employees of KT. Participants are prohibited from privately hiring KT tutors and will be responsible for any income lost to KT should they retain our tutors privately or solicit such employment.

Participants agree not to share KT Zoom links or logins for class instruction or webinars. Our tutors, instructors, and counselors may also send you links, but they are limited to only intended recipients. Terms of Service include that participants agree they will not share the content, products, services, advertising or other materials which may be provided throughout or program for the limited use of students.

Participants agree not to share, sell, copy, scan, digitally or electronically disseminate KT homework or classwork material. Participants acknowledge and agree that all documents, reports, plans, proposals, client files, trade secrets and any materials or Intellectual Property made or developed by KT are the property of the Company and shall not be used by participants in any way adverse to the Company’s interests. Participants shall not deliver, record or in any way allow such Proprietary Information to be delivered or used by any third party without the specific direction or consent of the Company. Participants also have no right or interest in the goodwill of the Company arising from its dealings with clients and affiliates.

No Indemnification

Participants agree to indemnify and hold harmless the Company and its affiliates, and their respective directors, officers, employees, agents and licensors (collectively, “Indemnified Parties”), from any claims, actions, costs, liabilities, expenses and damages, including reasonable attorneys’ fees and expenses, made against such Indemnified Parties by any third party due to or arising out of Participant’s use of the Site, Participants violation of these Terms of Use, or Participants violation of any rights of another user.

Photo & Video Waiver

Participants grant KT, it’s employees, contractors, and representatives to take and use photographs, video, and/or digital images of our participants for use in educational or promotional materials pertinent to Khan’s Tutorial as follows:

In printed publications or materials
In electronic publications or materials
On the Khan’s Tutorial website and affiliated websites owned and maintained by the organization (ex: KhansTutorial.com, KTLearning.com)
On Khan’s Tutorial operated social media sites, including but not limited to Medium, Facebook, Twitter, Instagram, and TikTok

Participants authorize the use of these images indefinitely without compensation to participants. Participants also consent to be identified and highlighted in KT educational and promotional materials. All negatives, positives, prints, digital reproductions, and video shall by the property of Khan’s Tutorial.

Privacy Policy & Collection of Information

KT is committed to keeping any and all personal information collected of those individuals that visit our website and make use of our online and in-person facilities and services accurate, confidential, secure and private. Our privacy policy and terms of service has been designed and created to ensure those affiliated with KT of our commitment and realization of our obligation not only to meet but to exceed most privacy standards. Through the use of our services, whether in person or at, *khanstutorial.com, or *ktlearning.com you are herein consenting to the following data procedures expressed within this agreement.

KT collects various types of information such as:

Voluntarily provided information which may include your name, address, email address, billing and/or credit card information etc., which may be used when you purchase products and/or services and to deliver the services you have requested.
Information automatically collected when visiting our website, which may include cookies, third party tracking technologies and server logs.

Please rest assured that KT shall only collect personal information that you knowingly and willingly provide by way of surveys, completed membership forms, emails, directly to a staff member, or through another method. It is the intent of KT to use personal information only for the purpose for which it was requested and any additional uses specifically provided by KT.

KT may have the opportunity to collect anonymous demographic information such as age, gender, household income, political affiliation, race and religion at a later time. When accessing the website, we may also gather information about the type of browser you are using, IP address or type of operating system to assist us in providing and maintaining superior quality service.

Use of Information Collected

KT may collect and may make use of personal information to assist in the operation of our business, services, or website and to ensure delivery of the services participants need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other possible products and/or services that may be available to you from *.khanstutorial.com. Khan and Khan Tutorial Inc. may also be in contact with you with regards to completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered.

KT does not now, nor will it in the future, sell, rent or lease any of our customer lists and/or names to any third parties. KT may find it beneficial to share specific data with our trusted partners in an effort to conduct statistical analysis, provide you with email and/or postal mail, deliver support and/or arrange for deliveries to be made. Those third parties shall be strictly prohibited from making use of your personal information, other than to deliver those services which you requested, and as such they are thus required, in accordance with this agreement, to maintain the strictest of confidentiality with regards to all your information.

KT may disclose your personal information, without prior notice to you, only if required to do so in accordance with applicable laws and/or in a good faith belief that such action is deemed necessary or is required in an effort to:

Remain in conformance with any decrees, laws and/or statutes or in an effort to comply with any process which may be served upon KT;
Maintain, safeguard and/or preserve all the rights and/or property of KT;
Perform under demanding conditions in an effort to safeguard the personal safety of KT staff, participants and/or the general public.

KT does not knowingly collect personal identifiable information from children under the age of thirteen (13) without parental consent. If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from our system’s database.

Dispute Resolution & Governing Law

This Agreement shall be governed by and enforced by the laws of New York. The parties agree that any claim, dispute or controversy arising out of, or relating to, this agreement, or the breach thereof, shall be resolved through final and binding Arbitration to be administrated by (“NAM”) National Arbitration and Mediation and governed by NAM’s Comprehensive Dispute Resolution Rules and Procedures in effect at the time such claim is filed. Any award of the Arbitrator is final and binding and may be entered as a judgment in any court having jurisdiction. The Participants Award shall be capped and limited to the monies paid by Participants to KT.
